Adventures from Yesterday’s Court Appearance for #TheLawOfficesOfDanielFDeraney.
Appearing in the State of New Jersey – Bergen County Superior Court – Law Division – Special Civil Part – Landlord/Tenant Division for Two (2) Eviction Actions.
First, a Non-Payment of Rent Eviction, representing the Landlord, against a Tenant in a Rent Controlled Apartment. With the Tenant behind (4) Months, a Settlement Agreement was reached to agree on the Tenants Vacation and the return of the Property to the Landlord.
Second, a Non-Payment of Rent Eviction, again representing the Landlord, against a Tenant, where the Landlord occupies the Premises. The Landlord attempted to Evict the Tenant under N.J.S.A. 2A:18-53, where the Tenant claimed, in defense, an Illegal Basement Apartment. Despite almost (4) hours of Mediation, a resolution was unable to be reached, pending a Municipal Court Violation for the Illegal Apartment, which entitled the Tenant to Relocation Expenses. The matter was voluntarily dismissed pending the disposition of the Municipal Violation.
